To me this is a bug, if not to you (the reader) then disregard.

in act_info.c, function show_char_to_char_1 find:
   if( number_percent(  ) < ch->pcdata->learned[gsn_peek] )
   {
      send_to_char( "\r\nYou peek at the inventory:\r\n", ch );
      show_list_to_char( victim->first_carrying, ch, TRUE, TRUE );
      learn_from_success( ch, gsn_peek );
   }
   else if( ch->pcdata->learned[gsn_peek] )
      learn_from_failure( ch, gsn_peek );


and right above it add:
    if( IS_IMMORTAL(victim) && (victim->top_level > ch->top_level) )
        return;
